Ogun Court Bars Demolition of Ex-Governor Daniel’s Property

An Ogun State High Court sitting in Sagamu has issued an interim order restraining the Ogun State government and its agents from demolishing or tampering with property owned by former Governor Otunba Gbenga Daniel.

The ex parte order followed an affidavit of urgency filed by Otunba Daniel and his wife, Yeye Olufunke Daniel.

On July 8, 2025, officials from the State Ministry of Urban and Regional Planning, acting through the State Planning and Development Authority, posted Notices of Contravention, Quit, and threats of demolition on the former governor’s private residence at Asoludero Court, the Conference Hotels Limited, and its annex—all located in Sagamu.

The State government, in a letter dated August 8, 2025, alleged that some buildings were constructed without proper planning permits and adequate setback.

In suit number HCS/371/2025, the court stated it was satisfied that immediate intervention was necessary to protect the property pending further hearings.

The judge barred the defendants, their associates, agents, and any persons acting on their behalf from carrying out any demolition, enforcing the quit notice issued on August 8, 2025, or interfering with the claimants’ possession of the property.

The property covers approximately 1.659 hectares and includes Block 1, Plots 7 and 8, and Block XXXVIII, Plots 1 and 12, within the Government Reservation Area (now Awolowo Avenue), Sagamu. It is secured by Certificate of Occupancy No. LUD3/LR2693, issued on January 20, 2010.

The court also restrained the defendants from trespassing or disturbing the claimants’ peaceful possession until the substantive motion is heard and determined.

In her ruling, the judge said, “Having read the supporting affidavit and affidavit of urgency, I am satisfied that this court must take immediate steps to intervene.”

She issued an ex parte interim order restraining the defendants and their agents or representatives from demolishing or tampering with the property known as Asoludero Court, or enforcing the quit notice dated August 8, 2025, pending the hearing and determination of the motion on notice.

An interim injunction was also granted to prevent any further trespass or disturbance of the claimants’ quiet enjoyment of the property.

Regarding the suit filed for Conference Hotels Limited, the judge affirmed the need for urgent intervention, issuing a similar interim order restraining the defendants and their agents from demolishing or tampering with the hotel property purchased from Segun Adesanya, who acquired it from Captain Kamoru Olatunde Alaba, the latter having bought it from the original allottee, Mr. Josiah Funso Ayankoya.

For the suit filed by Conference Hotel Limited and Blue Chapel Limited, the court granted an interim ex parte order restraining any demolition or interference with the property covered by Certificate of Occupancy dated April 8, 2004 (Registration No. 51, Vol. 612), pending the hearing of the motion on notice.

The court has adjourned the hearing for the interlocutory injunction application to August 19, 2025.
